Dealing with idiots (sorry PPCs!)

So...I had my reply back from a POPLA appeal last week (the appeal thanks to the help of the guys at Pepipoo)

The case was UKPC vs The Trainbasher...and predictably I won with flying colours!

Heres what POPLA had to say (Thanks Mr Westaby for the predicatble descision

The Operator issued a parking charge notice arising out of the presence at Merry Hill Shopping Centre on 24 June 2013, of a vehicle with registration mark TRAINBASHER.
The Appellant appealed against liability for the parking charge.
The Assessor has considered the evidence of both parties and has determined that the appeal be allowed
The Assessor’s reasons are as set out.
The Operator should now cancel the parking charge notice forthwith.
Reasons for the Assessor’s Determination
It is the Operator’s case that a parking charge notice was correctly issued, given that the Appellant parked on site in a clear contravention of the terms and conditions for parking. It is the Appellant’s case that, amongst other things, the charge does not represent a genuine pre-estimate of loss.
The parking charge appears to be a sum sought for liquidated damages, in other words, compensation agreed in advance. Accordingly, the charge must represent a genuine pre-estimate of the loss any breach may cause. The Appellant has requested that the Operator show a loss of income. The estimate must be based upon loss flowing from a breach of the parking terms. This might be, for example, loss of parking revenue or even loss of retail revenue at a shopping centre.
The Operator has failed to address this issue.
I must allow the appeal on this ground.
I need not decide on any other issues.

What Items Make Me Tick?

So yes, you lot get to see what makes me, that little known species called the trainbasher, tick.

Loads of coffee! No...not coffee but loads of other things. Like buses and trains. It seems to be that I can get a load but still be unhappy. Unhappy with myself because I need time to do things that I want to do but I don't know what I want to do.

Also, the thought of people taking away what I enjoy makes me mad, so mad that I convert it, somehow, into into a thing that keeps me going.

But the thing that makes me tick the most is my family. Family is key. Key at being the things that make me tick. Without family I wouldn't be myself, a  little known species called the trainbasher!

A branding on a route that my dad used to drive years ago when he was in the industry

Seriously though, without my family I do not know where I would be without them. I really enjoy the fun times with my family. Without them I would probably be a mere shadow of myself.

My dad inspired me to be the best I could be, both at home and whilst out. Some of my photographs were inspired by my dad working in the industry years ago and him inspiring me to live my dream, and nobody elses.

Also, my friends make me tick because I need some sanity in my life!

Without my family and friends I would not tick.

Some people may not have expected me to say what I have said but what I have said is true to me.

Welcome to...Meet the trainbasher

Welcome to the blog meet the trainbasher where you can find out more about me. I am a very rare creature who can be found on a bus or a train. Reading this blog you will find out more about me.

I enjoy traveling all over the country and will go almost anywhere that there is a bus or a train.

You will see a couple of sister blogs linked here along with some random musings I have made on other places.

I sometimes feel that I need to put my thoughts into words onto paper as such. The reason for this is I feel that I need to get it out of my system :-)

I will be answering questions on here as and when you want to and I will answer them :-)
